6. User-Generated Content

If you upload or submit Content through the Service:

• you retain ownership of your Content;

• you grant us a worldwide, non-exclusive, royalty-free licence to use, reproduce, modify, publish and distribute that Content for purposes of operating and improving the Service;

• you represent you have all rights required to grant this licence;

• we are not responsible for your Content and may remove it at our discretion.

7.1 Data Processing & Client Data

(a) Where you (the Client) upload or provide data to PrettySecure for processing in connection with the Service, you retain ownership of all such data. PrettySecure acts as a processor (or subcontractor) on your behalf and will process your data solely in accordance with your instructions and for the purposes of providing the Service.

(b) PrettySecure may engage sub-processors (third-party service providers) for the purpose of delivering the Service. PrettySecure will ensure each sub-processor is contractually bound to confidentiality and data protection obligations at least as protective as those set out in these Terms.

(c) Upon termination or expiry of your account, you may request return or deletion of your data. Unless otherwise instructed, PrettySecure may retain anonymised or aggregated data for internal analytics and improvement of the Service, but will not retain your personally-identifiable data without your permission.

8. Warranties & Disclaimers

The Service is provided “as is” and “as available”. We expressly disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose or non-infringement. We do not guarantee the Service will be uninterrupted, error-free or secure.

9. Limitation of Liability

To the maximum extent permitted by law, PrettySecure and its officers, employees, agents, partners shall not be liable for:

• indirect, incidental, special, consequential or punitive damages;

• loss of profits, revenue, data or business opportunities, whether in contract, tort (including negligence) or otherwise;

• any claim arising from or related to your use or inability to use the Service.
  Our total aggregate liability for all claims will not exceed the total fees paid by you in the 12 months prior to the claim (if any).

10. Termination

We may suspend or terminate your access to the Service at any time for any reason, including for breach of these Terms. Upon termination:

• your licence to use the Service ends;

• all rights granted to you cease;

• we may delete or anonymise your Content and data (except as required by law).
